Terms and Conditions of Use (T&Cs) – Couponeau

Article 1: Preamble and Scope
These General Terms of Use (hereinafter referred to as the "T&Cs") aim to define the terms and conditions under which the company Couponeau (hereinafter referred to as "the Publisher", "We" or "the Platform"), whose registered office is located at Washington Plaza Business Center, 29 Rue de Washington, 75008 Paris, France, makes available to its users (hereinafter referred to as "the User" or "You") its technical analysis and data services related to digital asset markets, accessible via the website https://couponeau-crypto.com. Access to and use of the Platform implies the User's express, unconditional and unreserved acceptance of these T&Cs. If You do not accept these conditions, You must immediately stop using our services.
Article 2: Definitions
For the purposes of these T&Cs, the following terms shall have the meaning attributed to them below:

“Digital Asset”: refers to any digital representation of value that is not issued or guaranteed by a central bank or public authority (e.g. cryptocurrencies).

“User Account”: refers to the personal space created by the User on the Platform, accessible via their login credentials.

“Services”: refers to all functionalities, market data, charts, and algorithmic indicators made available by Couponeau.
Article 3: Access to Services and Registration (KYC/AML)
3.1. Legal capacity:
Access to the Platform is strictly reserved for individuals who are of legal age (18 years old) and have full legal capacity to enter into these T&Cs.
3.2. Identification procedure (KYC):
In accordance with French and European regulations relating to the fight against money laundering and terrorist financing (AML-CFT), Couponeau reserves the right to subject access to certain Services to a rigorous identification process. The User undertakes to provide accurate, complete and up-to-date information (identity document, proof of address, source of funds). Any false declaration will result in the immediate and definitive suspension of the Account.
3.3. Account Security:
The User is solely and exclusively responsible for the confidentiality of their login credentials (e-mail address, password) and the configuration of their two-factor authentication (2FA). Couponeau disclaims all responsibility in the event of unauthorized access to the User's Account resulting from the User's negligence.
Article 4: Nature of the Service and Risk Warning (Execution-Only)
4.1. No financial advice:
The Couponeau Platform is a data aggregation and algorithmic analysis tool. The information, charts, and signals generated by our algorithms are provided strictly for informational purposes. Couponeau is neither a portfolio management company nor a financial investment advisor (CIF). No content on the site constitutes investment advice, or an inducement to buy or sell Digital Assets.
4.2. Risks of capital loss:
Investment in Digital Assets is inherently highly speculative and subject to extreme volatility. The capital invested is not guaranteed. The User expressly acknowledges that they may lose their entire capital and declares that they possess the necessary financial knowledge to understand these risks. The User makes their investment decisions in a completely autonomous and independent manner.
Article 5: User Obligations and Prohibited Uses
The User undertakes to use the Platform fairly and lawfully. It is strictly prohibited to:
- Use the Platform for illegal, fraudulent, money laundering or tax evasion purposes.
- Attempt to access the source code, perform reverse engineering operations, or modify the Platform's algorithms.
- Use automated systems (bots, scrapers, spiders) to massively extract data from the site without the prior written authorization of Couponeau.
- Attempt to overload, disrupt or attack the Platform's servers (DDoS attacks, SQL injection, etc.).
Article 6: Intellectual Property
All elements constituting the Platform (texts, graphics, software, algorithms, databases, logos, trademarks, interfaces) are the exclusive property of Couponeau or its licensors, and are protected by the French Intellectual Property Code and international treaties. Any reproduction, representation, modification, or distribution of these elements, in whole or in part, without the express consent of Couponeau, constitutes an infringement punishable by law.
Article 7: Limitation of Liability
7.1. Data provision: Couponeau strives to maintain accurate and real-time market data by relying on third-party APIs. However, Couponeau does not guarantee the accuracy, completeness, or latency of the data provided.
7.2. Financial losses: Couponeau and its directors, employees or partners shall in no event be held liable for direct or indirect damages, loss of profits, loss of income, or loss of data suffered by the User as a result of trading decisions based on the use of the Platform.
7.3. Availability: The Publisher strives to maintain 24/7 access to the Platform. However, Couponeau reserves the right to suspend access for maintenance, security updates, or in cases of force majeure, without the User being entitled to compensation.
Article 8: Force Majeure
Couponeau's liability cannot be invoked if the non-performance or delay in the performance of one of its obligations results from a case of force majeure, as defined by Article 1218 of the French Civil Code (natural disasters, telecommunications network failures, massive cyberattacks, pandemics, governmental decisions).
Article 9: Applicable Law and Competent Jurisdiction
These T&Cs are governed by and interpreted in accordance with French Law. In the event of a dispute relating to the interpretation, validity or execution of these T&Cs, the User undertakes to first contact Couponeau's customer support ([email protected]) to try to find an amicable solution. Failing an amicable resolution within sixty (60) days, the dispute shall be brought before the competent courts within the jurisdiction of the Paris Court of Appeal, notwithstanding multiple defendants or third-party proceedings.
